The State of South Carolina has been injuncted from executions using a firing squad and the electric chair. In striking down the law, Judge Newman noted that these methods violate the state’s constitutional prohibition against cruel punishments. Four death row prisoners had challenged the constitutional validity of executions by cruel methods of firing squad and electric chair. Relying upon expert testimony, the Court noted that the pain and bodily mutation caused by such inhuman methods are unconstitutional. Richland County Court of Common Pleas Judge Jocelyn Newman while striking down the law mentioned that South Carolina has “ignored advances in scientific research and evolving standards of humanity and decency.
