A Supreme Court bench comprising Justice DY Chandrachud and Justice Hima Kohli has banned Two-Finger Test conducted in rape and sexual assault cases and warned that any person conducting such test shall be punished. The Court expressed its regret over the fact that such unscientific tests are conducted even today. The Court stated that it re-traumatizes the women and is based on a wrong assumption that sexually active women cannot be raped. The Court directed the Union Health Ministry to ensure that survivors of rape and sexual assault are not subjected to the Two-Finger Test at any private and government hospital. The Court also directed that workshops be conducted for health providers to educate them on appropriate procedure for examining the survivors of sexual assault and rape. The Court further directed that the curriculums in medical school be reviewed for removal of the Two-Finger Test as one of the prescribed procedures for examining survivors of sexual assault and rape.
